Shingle Springs, CA asked in Family Law for California

Q: Do i need an attorney for a show cause situation for family law case?

I am the petitioner. My daughters mom is trying to get permission from the court to move out of state with my daughter.. She has even used fraudulent paperwork in the case to show she has a job waiting for her.Its clearly bs but i still need some info to feel better because i want to put this to rest. We have already seen a mediator twice. First was for me.. Second was for her..Daughters mom is doing all this to spite me because i remarried.. And now she is coaching my daughter by telling her she wont be seeing me soon because they are moving and we havent even got a decision from the judge yet..... Please help.. Will getting attorney help or will the state of california prevail on this one and tell her she cant leave with my baby??? Our trial or show cause is coming up in may.. Ive shown all the cause in my paperwork with the help of a family friend that works in the court.

Also, I am in my daughters life very much and have her the time our court order says.

A: Move away cases are very difficult cases to maneuver in California Court cases and it is always a good idea to have an attorney help you with these types of difficult cases, especially if you believe that the information your ex is putting before the court is falsified.

Your ex will need to be able to prove that it is in your daughter's best interest to move with her out of state and she will need to use the La Musaga factors in order to prove this. If she fails to address the factors listed in the California court case that is controlling this will be in your favor.

Nevertheless, complicated evidentiary hearing like the one you are about to endure should be done with the help of a competent attorney. If you have any questions please do not hesitate to contact me so I can assist you further.
