Annapolis, MD asked in Car Accidents for Maryland

Q: I was recently in a car accident that I'm pretty sure was the other driver's fault. I keep seeing advice not to talk to

anyone before a lawyer but I spoke to the police to answer questions at the scene of the accident. Was that a mistake?

A: Absolutely not. You are obligated to provide certain information by law to the police as well as other participants in the incident, if applicable. You are also obligated to cooperate with your own insurance company regarding the specifics of the accident. My suggestion would be that you don't speak to anyone else, and, to immediately consult with an attorney if you were injured in the accident, or, if you have questions regarding liability.

A: Everyone talks to the police, and those who fail to tell their side of the story risk having the other driver be the only version the officer hears, who may then end up listing you as at-fault when otherwise the officer may have made no decision or cited the other driver. You did the right thing. You must report the accident to your company, and cooperate with them. You should NOT talk to the other driver's insurance company before consulting with a lawyer.

A: Contact a member of the Maryland Assn for Justice--they give free consultations. Until you have that advice it's best not to talk to insurance companies as they often ask the wrong questions. In the meantime be sure to follow up with your doctor about your injuries.
