Q: I am a still married father of three year old twin girls. In jan. 2018 my current wife cheated and left to her grandpas.
My wife will not allow me to see my daughter's for no reason and the mom and two daughters and a nine year old boy. (A child she had before our marriage)all share a room. Are those enough reason for a judge to grant me custody or full custody of my children. With me they had an appt with own rooms and beds. Not to mention mom is already pregnant with another man who the nine year old boy has told me he is also sleeping in the same bed as my kids and drugs are certain. Also living at the resident is her sister who had a child who died because of drug abuse while pregnant and a refusal to go to hospital to have child. And two other children who have been taken from her and never returned. And I have seen my wife in town without my daughter's having her sister watch them but will nit allow me to watch them. It is obvious to me my wife is not making good decisions for our children. Please help me i am getting more worried as everyday passes.
A: You bring up very valid and concerning points that need to be addressed by a Judge immediately. It sounds like your children could be in harms way and you need to act fast. It would be in your best interest to file an Ex-Parte Request for Order Hearing regarding child custody and visitation and bring up all of the points that you did on this posting and to then go into detail regarding these issues so he understands your concern. You may file under a Petition for Dissolution (Divorce); Petition for Legal Separation or a Petition for Custody and Support depending on how you would like to go about your marital status.
