Q: I told the police my bf threatened me to make him leave our house, now he has a felony charge. What should I do?

I came home from drinking and starting arguing with my boyfriend, things got heated so I asked him to leave or I’ll call the cops. He said I always put him out or threaten to call the cops. I got in his face and told him I don’t care and he got upset and said to me “You stabbed me and I didn’t call the police on you. What if I did the same to you?” I didn’t take it lightly and I didn’t know if he was joking or not so I called the cops.

A: Tough spot. Are you protected by an Emergency Protective Order or Criminal Protective Order? Do you want to cooperate with the prosecution?

I agree that consulting with a defense attorney would be your best bet, both because they'll have an idea of what you need to do to help your boyfriend's defense (should that be what you want) and what risk you put yourself in for criminal liability.

If you were genuinely scared and want him to stay away from you, that's a whole separate story. Talk to a family law attorney with experience in DV cases. Or go to your local DV shelter and talk with a victim advocate to get an idea for the process of getting a DV Restraining Order.
