You can file suit but, before you do, please check your purchase contract to see whose responsibility the back taxes were. Normally, they should be paid by the seller on or before the closing date of the sale but this liability could be shifted to you as part of your purchase price. If this was the seller’s responsibility, you can file a civil lawsuit in the Justice Court so long as the amount of tax owed does not exceed $10,000.00.
If a sale for back taxes is imminent, I recommend paying the tax yourself to protect your interest and then suing for reimbursement.
