Merced, CA asked in Animal / Dog Law for California

Q: How can I get my dogs back from a rescue org. that I did not surrender them to but was forced to signed them over

I was being evicted and waiting for a ride to help remove my dogs when the sheriffs came and called animal control who then called new beginnings a rescue org. I was told i would get them back by one of the sheriffs when i asked why were they taking them, he said they were just going to check them over and make sure they were ok. when i called the rescue place a couple of times to find out about them i was told on the 3rd call not to call back that they did not belong to me anymore then they hung up. I have not called again but i have been looking for them online since they took them and about 3 days ago i located some of them at the milo foundation and one of them is up for adoption. i read the description and it states owner surrendered them but i did not surrender willingly, i did sign under duress. my dogs were not neglected or mistreated in any way!! i love my dogs, they aren't just dogs to my husband and I they are family. We have been very depressed since they took them.

A: I do not have a good answer for you, but I think you have a right to call New Beginnings and have them explain things to you. Unfortunately, once the sheriff and Animal Control get involved, you can pretty sure everything is going to get screwed up, especially since you signed the document under duress. Animal Control may believe they now legally own the dogs. Perhaps hiring an attorney and threatening to sue Animal Control might be an option. Good Luck.

A: You signed the dogs over. They are gone, even if you regret it now.
