Q: Need advice on signing an agreement to split the benefits of a buyout of a medical malpractice provider I used

Received an email at 8pm last night stating I have until 9/13 to sign an agreement to split the proceeds of a buyout of my previous medical malpractice provider(MLMIC) by Berkshire Hathaway. The anesthesia group I was employed by paid the premiums for my insurance but I was the policyholder. They state that legal counsel has told them they are entitled to 100% of the payout, but out of generosity they want to split 50/50. They also state that we may encounter a different legal opinion but they wish to avoid litigation/arbitration. I am suspicious of their generosity and the short timeline in which I have to act, especially since the buyout offer amount recently doubled.

A: Sounds like a scam. Berkshire Hathaway is a public company. Why would you get money from a buyout?

A: Probably a scam. Pay a lawyer to review the document and to advise you before you sign anything.

Do you have a copy of the agreement they claim you either signed or was entered into on your behalf? If not, that should speak volumes itself.

A: While an attorney could comment in general about the facts you present, some of which could be a cause for concern, it wouldn’t be a substitute for having an experienced attorney review the agreement.
