Scranton, PA asked in Car Accidents for Pennsylvania

Q: I was involved in a car accident where I was hit and it is not completely clear who is at fault. Scam?

The other driver is now harassing me and demanding I give her money out of my own pocket to pay for the damage done to her car. I provided her with the proper insurance information and she has yet to contact them and submit a claim. She also hasn’t given me any of her insurance info and I’m the one who was hit. I have reason to believe this is a scam and she purposely hit me to collect money. She is calling me guilty and claiming that I hit her when she literally t-boned my driver’s side door. My car is totaled now and I didn’t have collision coverage on it so my insurance won’t pay to have it fixed or replaced. What can I do from here? And can she sue me if I keep refusing to pay her out of pocket?

A: Anyone can sue anyone for anything, so you just can't worry about that. If it's to be, cross that bridge if and when you ever get to it.

As for the other driver's demand for cash from you, you certainly don't have to give her anything. You can send her a certified letter advising her not to contact you anymore as well. If she then still continues to do so, you can contact the police and file harassment charges against her. Let the insurance companies work it out, and put an end to her bullying in the meantime.

Best of luck to you.
