Q: Can I press charges on my ex for domestic violence if it happened a year ago?

Long story short he was arrested in 2014 for domestic violence but I dropped the charges because his family theatened me. He continued to beat me after but they made me think if I called the cops again no one would believe me. I’m no longer scared but my son is because he gets visitation. Can I still report him & press charges or how can I go about this? I need a paper trail or something to help me in court & I want to make sure my son is safe. The judge has told me because no reports were made they can’t keep my son from him.

A: There are consequences to domestic violence findings for the perpetrators of that domestic violence, 2014 would still be within the 5-year presumption period. You should consult with a family law attorney well-versed in domestic violence cases to see if you have a case for modification of child support. As for pressing charges, you'll need to reach out to the district or city attorney in your area. The crime's statute of limitations may have already passed and they may no longer be able to prosecute. Good luck.
