Q: I found out that my tenant is doing hair from my house which does not meet LARA standards. Am I able to evict them?
The lease that we signed, though not the greatest, does state that they are not able to conduct any illegal activities or illegal business on the property. Is this grounds for eviction? I have 10 different screen shots from her Facebook that show the house in the background and I have a public venmo receipt showing that she was paid by one of these individuals the same day the pictures of her hair being done is posted. Need to know what my options are here. Can I file a cease and desist order to require her to stop? Do I report her to LARA? I don't care to have her license revoked I just want them out of my property.
A:
I think you'll need more than some Facebook pictures to establish that this person is running a business out of your house. Unless they are open to the public - meaning anyone can walk in off the street to get their hair done - I'm not convinced what they are doing constitutes a business even if they are charging for their services. Think about it: friends and family members often times have someone in their circle that does hair and accepts money for it; that's not a business.
But let's assume they are running a business and you can prove it. You'd need to file a 30-day notice to quit. Depending on the judge, and what their response it, the judge could say "stop doing business but keep living there".
I would suggest sending a letter. If nothing else, it lets them know you are mindful and keeping an eye on them. You could report them to the state. Although if the state finds that they are not in fact a business subject to licensing, they will then feel free to do whatever knowing you can't stop them.
