Q: What (besides fees which are quoted at $5,000) can a co-op board do if owner of apartment illegally sublet his home?
Apartment was subletted out between owner and renter for 3 months but co-op board found out and is demanding tenant vacate immediately and $3,500 plus their attorney fees be paid by the owner. Owner had to leave NYC because father is very ill and mother is as well. Owner is having financial hardship as lost job and is single mother. The subtenant is a family friend in town on a 3 month contract at work and supposed to get their one year contract signed by their employer in December and owner was going to submit their full application for Board approval for a 1 year lease in November once this was available since Board requires employment proof. Owner (though no excuse) did not realize the subletting laws of building were so strict with no warning given first. Thank you.

The coop board may commence a holdover proceeding to evict the offending shareholder who is violation of the proprietary lease.
The shareholder might want to consider the adage “penny wise, pound foolish”. Personal circumstances do not change applicable law and experienced representation at the outset can save substantial sums down the road.
