Littleton, CO asked in Car Accidents for Pennsylvania

Q: MVA in PA after sunset on PA Hwy. Oncoming motorist had no headlights on collided with left turning vehicle. Caselaw?

I am curious if there is any PA case law on point with the above facts.

Also, what direction were you coming in--was the setting sun behind or in front of you? Was it raining?

Generally the left turning vehicle will be at fault. They have a duty to yield to through traffic.
