Q: Is it possible for an atty to fight to have benefits turned back on and a law suit too?
I was injured at work and filed the papers for Worker's Comp. They paid me my benefits up until I had surgery, which by mistake, Medicare paid. They stopped my benefits because my doctor did a whole knee replacement because they said I should of had a repair, not a whole knee replacement, which the doctor said I needed the whole knee replacement because I would be back in to have it done had I not taken care of it. I was told that an atty could have your benefits turned back on but he would still sue. He stated he could do both, even though there would be a law suit against them. I thought it was one or the other?
A: Theoretically, he can do both IF the need arises, although you may be able to resolve it simply by reopening your case.
