El Paso, TX asked in Child Custody, Child Support and Family Law for Florida

Q: I have full custody of my boys but one had to go live with his mother in FL and I live in TX, can she file for support?

I have tried to file for support since 2009, but we have lived in different states and the courts could never seem to get her served. I have a case number from VA and I just received a letter from FL stating that a support case has been opening against. I have sent my son 150.00 every month and have not received any support for my son that lives with me. What can I do she lives in FL and I live in TX? Both of my boys lived with me until recently.

A: Unless you do something to prove you are supporting your son who lives with his mother in Florida you will probably end up receiving a final order requiring you to pay additional support. You should contact a lawyer who practices law in Florida, preferably in the city where the new case id being opened (probably here in Tallahassee).
