The clerk does not send notice to the beneficiaries. The lawyer representing the executor does. The notice should include a copy of the Will. No petition is involved.
A: The Clerk does a public posting of the probate; however, the Executor or the Executor's attorney will send notice to the beneficiaries which typically includes the order admitting the will to probate, a copy of letters testamentary issued and a copy of the will. It is necessary to file a compliance affidavit after notice has been provided.
