Q: Can my husband and I sue terminix for falsely selling us an agreement and now saying we don't qualifying?

We have been living in a nightmare for the past year and a half. We purchased a plan from terminix on our home for termites. When the inspector came she told us we would be covered on everything from treatment and prevention to protection. That was the only reason we chose them. They offered a annual fee and we excepted also. From the beginning our home was never treated properly. Their tech lied and never installed our pods nor sprayed where the inspector had said to. He no longer works there. And when they finally sent someone else they still didn't treat properly. Then about 4 months ago I fell through my dining room floor and a swarm of termites filled our home. When I called them in a panic they did nothing! Now they are saying we didn't qualify for their property protection. We have several witnesses that can testify that we were told by their inspector and another of one of techs their we did. We were also told the inspector no longer works there. How convenient for them. Help!
