North Hills, CA asked in Criminal Law, Personal Injury, Civil Rights and Probate for California

Q: What type of lawyer would I need in my situation?

I'm in a situation where I'm on probation. I was injured while incarcerated, sued the sheriff's department and won a settlement. The check was handed over to probation during my release and they are keeping it in a safe deposit box. I thought that was strange. I obtained my own lawyer who helped me win and brought my check to the jail to put on my property and they think they own it? It should have been released to me the day I was released. Probation has been promising me that they are going to issue it on certain dates and then those dates get here and something comes up on their end. It has been 4 years and I still have not gotten my check. I have seen it with my own two eyes but it was not issued to me. I feel like they are using it against me to get me to cooperate in certain programs and things while on probation. That I have to do anyway. Haven't even been in any trouble. I work 50 hours a week and I'm doing what I need to do. It just doesn't seem right.

A: That doesn't sound right. Contact an attorney to discuss your potential claim in detail. You can seek out your original attorney, or a new one.

A: Talk to your attorney who helped you get the settlement. If you get no where then consider talking to another lawyer but you must take action right away to avoid any statute of limitations problems.
