Q: What is the statute of limitations on VTL 1123 (New York)?
On July 25, 2018 I was pulled over and issued a ticket for violating VTL 1123. (After the fact, I realized I actually violated VTL 1124, the officer referenced the wrong statute.) I pleaded not guilty and received paperwork from the town court confirming they received my plea and noting they would schedule a pre-trial conference when the caseload permitted. Since that time, I have heard NOTHING. I have not moved nor changed my contact information in any way. Since it's been over a year since I was pulled over, I was wondering if the statute of limitations expired. I also checked the status of my driver's license with the DMV and it stated there were no issues, I could drive legally. If I missed a court date, I assume they would have sent me paperwork telling me they ruled against me for not appearing. Any thoughts? I don't really want to call and inquire if the statute of limitations have not run out - I don't want to suddenly appear on their schedule.
A: There are a number of points in the proceedings where different statutes of limitations apply. I assume you are asking about the start of the case, which is one year form the date of offense. If that is not what you had in mind, ask again with more specificity.
