Q: I was in an accident and I was hit from behind I have no insurance and there was no police report made. Am I responsible
He claims I ran a red light and I disagree regardless he hit me from behind
A: Hard to understand how running a red light caused you to be hit from behind. Ordinarily, the driver of the car that strikes from behind is liable. Since you were uninsured, you are not able to recover damages for pain and suffering, unless the other driver was DUI. You can recover for your property damages, rental car, medical expense and wage loss (if you were placed off work due to a doctor's order). Civil Code section 3333.4
