The executor of our will is saying that he does not to show us any paperwork except the will. We asked to see the paperwork to show how he came up with the inheritance amount but hes saying he doesn't have to show us. It's being split between 2 people. There's a sale of a condo, then repayment to my sister for bills she paid out of her account then its split up. We just want proof of the Bill's she's being reimbursed for, the total sale of the condo and the final Bill's that were paid off for the deceased. Dont we have the right to see this?
A: 15 months after the executor has been appointed by the court a beneficiary may demand an accounting. An executor has 60 days to produce the accounting.
A: You can also obtain a lot of information directly from the probate court. It is public information.
A: Terry is correct. However, you should also take a look at the will. A lot of times, the will states that the beneficiaries are allowed to request an accounting. If the will says you can request an accounting, then you can request an accounting from the executor at any time. If the will does not say that you can request an accounting, then you have to wait 15 months from the hearing date before you can request a hearing.
Tammy L. Wincott agrees with this answer
A: Check with the probate court to see if an accounting was filed. If not, then review the will, as suggested and/or request the accounting 15 months after entry to probate.
