Q: What form or forms should I be completing to respond to a motion filed by my ex-husband? I do not agree with his motion

My ex-husband and I filed our own divorce paperwork in 2014. He filed a motion two weeks ago that I disagree with and need to file a cross motion. I want to make sure I am filing the correct forms and providing the correct information. The more I read about the content of cross-motions, forms, exhibits, the more confusing this has become. I have my own statement of response to his motion along with all exhibits I need to respond to his claims, my case information sheet, w-2s, pay stubs, 2018 tax returns, previous judgement and a copy of his motion. I am second guessing myself on what forms to fill out. We have an FM docket #.

A: Thank you for your question. Although the Court does have forms to address the application that has been filed, it would be best to consult an attorney to ensure an appropriate response is filed. As you note, this process can be difficult. Certain rules must be followed in order to ensure that the application will be considered by the Court. In addition to filling out the paperwork, there are specific time constraints in filing an opposition. As such, you may need to seek an extension so you can file the right paper work. Based on your circumstances, it would be best to contact an experienced family law attorney to address your specific concerns.

A: Thank you for your question. Motion practice is detail oriented work, and a misstep could make your response papers inadmissible. Do not make an already stressful situation even worse. The outcome of the motion is too important to take chances. You should consult with an experienced family law attorney who can guide you.
