Fresno, CA asked in Consumer Law for California

Q: Moms BK finalized in July. Trustee paid off my car loan as she was the cosigner? Does this mean he gets to keep my car?

So my mom's bankruptcy was finalized in July of this year. The trustee kept her state and federal refund checks. My mom is a cosigner on my vehicle and I was trying to make a payment a couple days ago and they told me that my car was paid off by the trustee. Does this mean that my car now is the trustees property or do I get to keep my car? Thank you in advance for your answers. I am really stressing out at this point

A: Being a co-signer on the loan is not the same as being an owner or co-owner on the title. It is unclear whether your Mom had any ownership interest on the title. If you were the registered owner, the car should still belong to you.
