Q: Hi, I was wondering if my husband needed to file form 1-589 if I've already filed I-130 last year (2018)?

We've received a receipt almost a year ago stating that my application was received is being process, but there's been no update since then. I've requested an inquiry just now. I'm just worried since he has another court date in Feb 20 and we haven't heard anything yet.

(I should hear back from USCIC by 12/25/19 about the case inquiry.)

I should also state that his visa had expired a few years ago and he's facing deportation. His last court visit was back in September and the judge had gave him the I-589 application. We just didn't do anything because we had expected to hear back from USCIS by now.

A: Please defer to the advice of the attorney who is representing him in immigration court. if he doesn't have one, i strongly suggest you hire an experienced deportation defense lawyer.
