Q: Even if I make a large amount in tips is my employer still required to pay me my minimum hourly rate?

A: Your employer must pay you at least the Ohio minimum wage for tipped employees. The Ohio minimum wage for tipped employees is $4.30 per hour. However, if you are a tipped employee (someone who receives more than $30/month in tips), and you are paid more than the minimum wage for tipped employees, then your employer may claim a “tip credit” to reduce the hourly wage it is required to pay you. For example, if you make $7 per hour and regularly receive $10 in tips per hour, your employer can claim a tip credit of up to $2.70 per hour worked (Your wage of $7 - Ohio minimum wage of $4.30 for tipped employees).
