Columbus, OH asked in Employment Law for Ohio

Q: Bathroom breaks. I was denied a 5-8 minute break to change my tampon. I couldn’t wait for lunch; it’s 2 hours away

my question is in regards to bathroom breaks. I was to work 11 hours minus my lunch (30 mins) and 3 breaks with 2 hours 45 Mins in between each breaks and lunch. I was on my menstruation and my manager gave me a verbal warning for taking an 8 min bathroom break to change myself. I asked her if I go to the bathroom anytime between 9:30-12p if I would get a written warning because I might need to change again. She said she won’t stop me from using it but I will be disciplined for it. I can’t wait over 1 hour to change myself because I have a heavy flow. I ended up bleeding all over myself because I had to wait over 2 hours to change. Is this against any law or is this even legal? I’m embarrassed and have no idea what to do. Please help! Thank you.

A: This sounds like it could be gender discrimination to me. You should contact an employment law attorney as soon as possible to discuss the situation in more detail. Some will offer a free initial consultation.
