Q: If a lawyer set a court date for me on a 16 year old bounced check. Is the warrant still active? Or am i okay till then?
16 year old bounced check warrant in NC. I live in another state right now. I just found out about the warrant. I hired a lawyer. He now has a court date for me. Being i now have a court date, does that nullify the warrant til court date? Also isnt there a statute of limitations on this. All also there was a seat belt ticket they say i didnt pay. My lawyer told me 1500 total and all is taken care of. Is that about a fair price?
A: If you have already hired an attorney, the logical thing for you to do would be to call the attorney you hired. Asking questions on a public forum like this kinda defeats the purpose of having hired an attorney. As to whether the warrant is still active - sometimes they are stricken prior to the case being heard, sometimes not - that is a question for the attorney handling the case. There are statute of limitations for misdemeanors that have not been charged - you have already been charged, so no easy out for you and again a question for the attorney you hired. If you have a seat belt ticket - ask your attorney if that is part of what they are handling for you at $1500 - it likely should be. As to the quoted fee. Depends on what the $1500 covers and what the amount of the check was. If the $1500 covers everything as you indicated you believe it does and the check amount is in the $500 to $750 range then the quote would be reasonable in my subjective opinion. If the check amount you have to pay back is less than $500, then the fee becomes less and less reasonable the further down from $500 the amount of the check was. However, this is just my opinion. Legal fees vary from attorney to attorney and from area to area as does what is reasonable.
