A: Adultery is a crime in Oklahoma, 21 OK Stat § 21-871. It is a felony, but the reality is you will have a hard time finding a DA who will actually file those charges. In my opinion, your better course of action is to file for divorce and then fight for custody, especially since the courts tend to frown on a child being confronted with a parent sleeping with a new person while they are in the residence.
