Q: Merchant has a signed receipt but never billed credit card and CC account is closed. Am I liable for the charge?
On 12/18/19 I purchased access to an online educational platform for SEO via credit card over the phone for a total of $5860. The representative confirmed the transaction and forwarded a receipt listing it as completed and I e-signed a receipt with the last four digits of my card on it.
Aftergaining access to the platform, I found the contents extremely poor and not usable.
Although I received a receipt, my credit card was never authorized or charged for the transaction. 45 days after 12/18/19, I cancelled my card account. Am I still liable if they never charged, but theyhave signature?
They recently contacted me (I have not responded) claiming that the funds were "on hold" for over 60 days and have just been released. My card company says there are no holds or authorizations. Should I respond to the merchant? Can I be sued?
A: Without a full review of all facts and documents, no one can opine definitively here, but, your point "Aftergaining access to the platform, I found the contents extremely poor and not usable." is likely the best place for you to focus your efforts when push comes to shove. Good luck with it.
