Fuquay Varina, NC asked in Bankruptcy, Consumer Law, Foreclosure and Real Estate Law for North Carolina

Q: Is an investor/trustee suppose to be listed anywhere on the original NOTE or DEED of a trust?

A bank called Deutsche Bank has stated that they are the trustee on my loan and I have never heard of them prior to them trying to foreclose on my property. They are not listed on any paperwork that I have had nor my DEED. They are listed on MERS but it states INACTIVE. I have been approved for refinance to pay off this debt but and I am getting no response from the servicer PHH or their lawyers. Will the judge at the hearing even try to help?I have not been able to get any information from the servicer who is not listed on MERS as my servicer. Confusing. I just need to know who owns the lien to pay and how much?

A: You need to have a lawyer look at this for you but DB does not have to be listed on the deed or trust if they subsequently purchased it.
