A: The use of cell, phones and electronic devices is gfoverned by VTL 1225-c-2 and 1225 d(1). It is a five point violation (11 points suspends your license). If you have a probationary license or learners permit, those can be suspended. 2nd and 3rd offenses increase the fines and will make it less likely the prosecutor will make a plea deal to a lesser offense. You will also get a DMV surcharge. It is best to use an attorney to negotiate a lesser plea.
