Lehigh Acres, FL asked in Family Law, Child Custody and Child Support for Florida

Q: What steps need to be taken to Modify an injunction?

My ex girlfriend has a permanent injunction against me for almost 2 years now. My 5 year old son is included on it as well so I have not had any contact with him for 2 years. I would like to get a time sharing plan set up as well as start paying child support. So do I need to file a Petition to Establish Paternity first? Or do I need to file to modify the injunction to allow me supervised visitation with him? With COVID going on are modifications of injunctions considered “essential” proceedings?

A: You are going to need an attorney. Contact one who can address all of those concerns.

A: Why are you in such a hurry--after waiting two years? If your name is not on the child's birth certificate as the father your will never be able to get visitation rights. Got it?
