Crestview, FL asked in Civil Litigation for Florida

Q: Florida runaway laws, what about safety and rights of parents especially during a pandemic.

How can CPS and State laws disregard the parents Civil Rights, and force a parent to take in a deliquent teen risking the lives in the home while a pandemic is going on or charge a parent with felony abandonment. I would prefer answers from Non-Florida Attorneys that are able to address the laws of Civil Rights being violated. Out of control teens shouldn't be able to endanger the lives of themselves and others in a National Emergency. Humans have a right to life that's a Right! Florida seems to not recognize our Civil Rights in totality. To be a parent doesn't entail risking your life. The reason for requesting non-Florida lawyers answers.. as you see from their responses, they are not comprehending. Justia should delete my question since they give no option to do that for questioners. By the way a Florida runaway couldn't win the lottery so that logic makes no sense.

A: When you have a kid, you are legally responsible for his/her health, safety, and welfare until his/her 18th birthday, at which time you are free to say "goodbye and good luck." If you have such a tragic problem that it causes you to wish to abandon your own child, contact a social worker to determine lawful ways to address the problem.

A: I'm curious why you want non-Florida attorneys to respond. Florida attorneys are also trained in these areas.

A: You are responsible for all your children and everything they do or don’t do until they are 18. You would be happy about this law if your run away won the Lottery-right? Well guess what: the same law applies both ways.

A: I see you edited your inquiry after I and two other attorneys responded. You are emphasizing that you fear for your life if your child is in your home. Also, you apparently already attempted to address the problem by contacting "CPS", by which I assume you mean child protective service of the Fla. Dept. of Children and Families or your Sheriff's Office. My prior answer still applies - CONTACT A SOCIAL WORKER. That will probably accomplish something, but if not, consult a family law attorney in your geographic area to determine if there is any avenue to petition the court for some kind of relief.
