Bronx, NY asked in Traffic Tickets for New York

Q: Tickets from 2 years ago

I got a ticket 2 years ago in the bronx for texting and driving which is 5 points. Than a ticket 2 months later which I didnt plead guilty to for going 21 over the speed limit which is 5 points. My court date is in mid july if I get convicted would it automatically suspend my license. After this ticket I received no more traffic violations. Plus I need my car to drive to school and work? Ant thought.

A: Take an online defensive driving course. It may help you depending on the exact date of the previous violations.

A: Your point total is calculated based on the date of the violation, not the date of the conviction.

The points for violations that all occurred within the last 18 months are added to calculate your point total. In essence if over 18 months passed since the date of the violation, the points should not be added to your total at conviction.

If you get 11 points in an 18-month period, your driver license may be suspended. However, the points system is not the only way a license may be suspended.

A: Speeding 21 over the limit is 6 points, not 5. Based on your representation that both of these tickets happened 2 years ago, we are guessing that both tickets were issued in the 5 boroughs of NYC. In that case, the TVB judge will have discretion to suspend your license, or not to suspend your license.

Good luck
