A: A person without lawful status in the U.S. can marry a resident within the U.S. if the requirements of the jurisdiction where the marriage will occur are fulfilled.

A: As long as your marriage is bonafide, there is no restriction for marriage. The issue of unlawful presence only arises if you seek to adjust status now.

When the GC holder spouse becomes a U.S citizen, the undocumented immigrant spouse becomes an immediate relative. The unlawful presence restriction is waived for immediate relative.
