Q: Why is Kansas not extraditing

We were pulled over in Oklahoma and my nephew had a felony warrant in Wichita KS but they didn’t want to extradite

A: Several reasons could exist. Generally, when it is a felony warrant and the state is a border state, the state with the warrant will extradite. That said, it could be that because of COVID, a limited budget to transport inmates from other states, or a limited jail space in the county from which the warrant was issued Kansas decided not to at this time. It could be something else too. Your nephew, however, should contact an attorney in Kansas to resolve the warrant and take care of the matter, so it does not become an issue in the future. Just because they refused to extradite him does not mean that they withdrew or recalled the warrant. I imagine the warrant is still valid, and next time they could extradite him.
