Glendale, AZ asked in Consumer Law and Small Claims for Arizona

Q: my mechanic said that the new engine was stolen by a guy at the dealer he ordered from. What can I do about this.

My gasket blew and I took it to my mechanic. I decided to buy a new engine and payed my mechanic up front for parts. After weeks he said that a guy from dealer stole it and engine was not delivered. He said when I asked that their was nothing legal he could think of to do about the dealer he ordered engine from. I am wondering what I can do about the people that it was ordered from as well as if my mechanic is just plain not telling the truth. The mechanic said he would just have to bite the bullet and get the money and asked for a month. This was in beginning of July. I called last Monday July 25th and have not heard back from my mechanic as of time of writing this message. What would all my options be at this point. I haven’t confronted mechanic yet about him not telling truth and am looking for any advice on how to move forward.

A: If your mechanic ordered the engine from a dealership and it is stolen at the dealership while in their custody, the loss is taken by the dealership and they would need to order a new engine. The allegations by your mechanic just don't sound right. If he purchased an engine, he must have a receipt of the order and proof of payment. If he doesn't provide you with a copy of each so that you can confirm the story with the dealership, seek an attorney that can look into this matter and take action.

Good luck.
