Q: is it legal to sell me a used car without telling me the title was branded for odometer rollback?

i purchased the car 3 weeks ago, the title was branded in 2016 in indiana, i bought the car in kentucky.

A: There are both state and federal laws at play here.

Federal law requires that a seller state the mileage upon transfer of ownership. Failure to complete the mileage statement or providing a false statement may result in fines and imprisonment under the Kentucky odometer law - KRS 190.300.

If an odometer rollback is discovered after the vehicle has been purchased, the buyer is entitled to three times the actual damage or $1,500, whichever is greater, plus attorney's fees and court costs.
