North Highlands, CA asked in Civil Rights and Constitutional Law for California

Q: Can I sue for harassment? Invasion of privacy? What can I do to stop threats I get 3 or 4 yearly?

I live in a senior mobile home park, mobiles are owned by tennent, spaces rented monthly. Management inspects property often but never gives notice. They take potographs of patio, porch, yard and space under mobile, then posts letter with threats of eviction actions for things like: any item under mobile, "unapproved" outdoor furniture, powerchair, small freezer, items on table, bicycle, on back patio, fairy lights, bagged soil, rake and shovel in garden. lock on back gate, gloves and boots by back door, etc...

Seems very unreasonable to expect any item not kept inside mobile when not in use to be "approved" or expect legal eviction. I have heard many accounts of the park eventually "acquiring" the owners mobile homes as most are too old to legally relocate and by causing delays with "red tape", fees, regulations to sell, litigation expences etc... Many try at first but lose mobile anyway. Some homeless. immoral

A: Sorry that you are having to deal with this at a time when you should be resting on your laurels. In my experience the operators of MHP are often little dictators with the park as their empire. The believe they are the law. You should sell and move to a better place, if possible, because what they are doing is not technically a violation of law, or harassment recognized by law. Clearly it is harassment, and you are suffering from it. Start the sales process very early so you can deal with all the red tape, get a Real Property attorney involved when there are problems, not just the Realtor.
