Q: I purchased a New 2019 Ram Promaster in CA in May 2020, with Open Saftey Recall
A New vehicle purchase in CA with Recall #W00 2014-2019 VF SHIFTER CABLE. The dealership sent me a free carfax for the van I purchased and it showed that parts were now available for the open recall repair. I called the service department to schedule the repair and was asked if I was the owner of this Construction Company, no I replied, he said that the van is registered to this company.
I called Chysler Corp and was told the van could not be sold as a new vehicle with a open recall. I was told to go back to the dealership and find out if the paperwork was possibly mixed up with the Construction Company. She also said that they would file a complaint with the dealership.
I think I was sold a used vehicle ( mileage at time of purchase 259 miles) at a new car price? What are you thoughts and what is my recourse?
A: That is right. They are not allowed to sell a new vehicle with an open recall, so, have a lemon law attorney look at your sales documents.
A: You need to call and speak to an attorney who does dealership fraud. You also want to inquire with the DMV as to the vehicle history to see if the vehicle was new or used, and who exactly is registered with the DMV under the vin number of the vehicle.
