Los Alamitos, CA asked in Criminal Law for California

Q: My brother in law is being accused of a lewd act on two different girls under 14 in orange county.

The first girl is his step daughter of 9 years and made the accusation they day after he proposed to her mom. Second girl is the daughter of their best freinds who said nothing happened at first, then after pressure from the father says their was one incadent at a camp out which they where all their. She said he grabed her hand and pulled it towards his croch area. I have talked to a few attorney and got mixed signals i heard a judge will not take into consideration the second girls testimoney because it is best freinds of the first girls parents and looks like a set up. Is this the case?

A: The second girls allegations make the case stronger for the prosecution. It is common for young kids to change their stories when asked by parents, police or teachers.

A: much more info needed.

the issue will be what weight should the court give to evidence.

my favorite all time case was similar. Mother got married and 12 yr old daughter said new dad came into room and put his thing in her thing.

i crossed her for a long time and locked down day and time of the week and who her best friend was and if and when she told her.

i got her to admit she made it up b/c her mom was not giving her attention like she used to get... and all attention was going to new Husband...................

that doesn't mean that is what is happening here.........but maybe?
