Chicago, IL asked in Divorce and Immigration Law for Illinois

Q: My spouse filed for divorce without telling me, he got my stimulus check and refused to give it to me. What do I do?

We have been having problems for a while now, I got my Green card a few months ago and last month, I got divorce papers from his lawyer. I didn't even know he was filing for a divorce. He got my stimulus second stimulus check last month and refused to give it to me but he's still contacting me and saying Happy Valentine's Day. This is stressing me out and I'm not sure how to handle this since I don't have legal representation. I'm very worried about my green card too since I got it through the marriage.

A: More information is needed. How long were you married when your adjustment of status was approved? When does your green card expire?

I strongly recommend an appointment with a competent and experienced immigration attorney who can spend enough time, find out the facts, and suggest what is your next step in the immigration process. You will also need a divorce attorney.
