A: Yes, an express warranty is what most people think of as a warranty, one that is promised by a seller usually in writing. An implied warranty is a bit different. It is one that is implied by the law, in other words, one that is essentially required by law and therefore present whether there is a specific agreement or not.

A: I agree with Mr. Williams. An express warranty is one that is clearly laid out, and usually in writing. An implied warranty is usually one imposed by the law. Less is usually required of an implied warranty, and you may waive those protections depending on the surrounding facts.
