Q: Hi. Thank you In advance! Can I be evicted currently?

Landlord states I’m past due and owe 3200. last payment was 3000$ with stimulus money. I have three minor children, one of whom is diagnosed with a disability and receives SSD. Is the moratorium still valid on non payment due to COVID-19 hardship? I am SE EMPL, receive unemployment, have applied for all assistance available keeping him in the loop entire time. I asked for his assistance in filling out United Ways’ Cap program. According to UW, my application is just sitting in pile waiting on landlord to provide W9, and info regarding payment to him. I received a text yesterday saying exactly this… Pay your rent you have 24 hour after that sharif will take action I file eviction I know you have miner baby but I can’t wait almost 5 month rent. I am 4 months behind and owe “3200$“including recently added “fees”. What is the law, process of eviction; is moratorium still valid, and do I stand a chance? Appreciate any and all assistance!!!

A: No, I don't believe the moratorium is still in effect. Basically, having already given you notice, what the landlord needs to do is file a complaint with the court and schedule a hearing. At or before that hearing, you must deposit the past due rent and other charges with the court. If you don't do that, a writ will be issued, which will give the sheriff authority to remove you from the premises.
