Q: Consumer Protection/Rights and Prevention of Wage Garnishment for debt that is not ours!

Hello, my husband and I live in Florida and a company supposedly bought this debt from Home Depot and is now trying to garnish my husband's wages. My husband is the only source of income that we currently have, I am pregnant and lost my job due to Covid. We won't be able to afford our mortgage payment, put food on the table and other basic living necessities as we are barely making ends meet. Not only that we asked them to provide us with proof of purchases that were made totaling the $9,100 they claim is owed. They were not able to do that and sent me statements that did nothing to prove that. They have also made false accusations towards my husband diminishing his character by claiming he purchased items and had no intentions of paying for them, which his employer saw in the complaint and that doesn't look good. What can we do to stop this?

A: If they are trying to garnish your husband's wages, it appears that they have a judgment against him. If that is the case, you might want to send them proof of your financial difficulties; if you do so they might not apply for a writ of garnishment at this time.
