Q: If the court doesn't have jurisdiction is a no contact order enforceable?
The court ordered a no contact protection order. Theres an x next to conditions of probation. Which means that the court only has jurisdiction as long as the defendant is on probation. The defendant was not granted probation in this case. Therefore the defendant is not on probation. The no contact order is valid until January 2022 but since the court does not have jurisdiction due to the defendant not being on probation, is the order enforceable? No jurisdiction means no jurisdiction correct?
A:
it depends and that is why the best person to ask this question is the lawyer who represented you.
s/he has all the facts and can provide an intelligent answer that is most likely to be correct.
A: A criminal protective restraining order can be a condition of probation, but it does not have to be. One can be issued to restrain an individual who is not on probation, and the court will have jurisdiction to act on a violation as long as the RO is in effect.
