Q: How close is the initial settlement offer to the final from an insurance company? Like night or day?

A: It depends... on the facts, the injuries, the adjuster, the insurance company, the status of your case, and even the attorney representing you. No random lawyer can answer a question like this without specific details. Consult with an attorney or several attorneys to get a better idea of the value of your case.

A: There are way too many variables to be able to answer that question. However, if you are talking about an insurance claim, the insurance company has a duty to conduct a reasonable investigation and pay the undisputed amount. Therefore, settlement offers should be reasonably close to what the claim is worth (but sometimes they are not). If you are talking about an insurance bad faith lawsuit, it depends where you are with the case, what you can prove, how close you are to trial, how much your contract damages are, and about 20 other factors.
