A: If you were injured and fault for the accident was placed on the driver of the car, you have a claim against the driver's insurance policy. If the truck was determined to be at fault, you have a claim against the trucks insurance policy. Either way, no contributory negligence can be attributed to you.

The only situation where it would be difficult for you to recover is if the driver of your vehicle was at fault for the accident and his/her insurance had lapsed. Even though you have a great case, it would be impossible to find an attorney to assist you because though you have an excellent claim, THERE IS NO ONE TO PAY the claim unless the driver is wealthy, beyond reason. Few such people permit their auto insurance to lapse.
