Millville, NJ asked in Legal Malpractice, Medical Malpractice and Wrongful Death for New Jersey

Q: Possible medical negligence or malpractice?

I need advice.. My Father passed away on February 1. He had health conditions but his death was unexpected. Mid-January he had a nephrostomy done. The hospital refused him anesthesia for it because a COVID test was not done then gave him a fentanyl drip instead. I think the effects from this is what eventually killed him. At the time, he was already on high doses of pain medicine. His lawyer called to give his condolences and wanted to talk about this. Should we pursue it? I do not know anything about this. Thank you.

A: I'm very sorry for the loss of your father. For your question as to whether to pursue, that's a personal decision and it could additionally hinge on whether a law firm identifies the basis for a medical malpractice claim - that generally involves the input of an opinion from a medical professional. Attorneys can't make that medical call. You could speak with attorneys (it appears you already have one) to learn more about your options. If you do contemplate action, it would be advisable to discuss with an attorney without further delay to learn about the timeframes within which you must take action to preserve your rights. Good luck

A: Correction - My response from a minute ago should have included "wrongful death" - " ...basis for a medical malpractice/wrongful death claim... " I apologize for that omission from a minute ago. Good luck
