Q: My car got hit by a truck with a trailer but the trailer has no insurance coverage. What should I do in this case ?

I and the guy who hit me have the same insurance company and we both file the claim separately. I talked to both my claim adjuster and guy’s claim adjuster. My claim adjuster told me he has done everything from his side and while I talked to other adjuster she say go through with my insurance but I don’t want to coz that was not my fault and I have a witness who already talked to them. So my question is what am I supposed to do now? It’s not a severe damage and it’s been 3 weeks . They are not responding me.
