Q: I’m a military spouse. I have full sole custody of my 10-year-old son. I currently live in Italy until 2024.
I have custody papers I would like to know if they are still good even though i moved to another country. His dad has visitation and also signed for him to have a visa to live in Italy. He gets him during summer time June-August. He shares visitation with my parents who live in the same state as him. When Child Support was first established my ex was working making like nine dollars an hour. in 2017 I had papers drawn up A set amount was put in my papers for $58 a week and I know he makes more now than he did when Child Support was first established. I sent a request for a raise through DHS about a year ago and from what I gathered it was denied due to me having a set amount in my custody papers.Do I have to go to court to get a raise of child support? And if I do is there a way I can do it remotely/zoom instead of flying back to the states? My ex will not agree on new papers without a fight in court.
A: They are still valid, though they may not address your current situation. If your payments are going trough Child Support Enforcement, they can gather the information needed to reevaluate support. DHS is not involved in child support. Child support ism modifiable in all states based on changes of income with change thresholds established by state law.
